'Is Hellwig right, and is VMware a derived product of Linux? Unless vmkernel can be loaded without the Linux kernel, it would appear so. VMware was developed from another, long ago OS created as a research project, but it's unclear whether vmkernel was ported from that OS or rewritten as the Linux-requiring binary blob. Vaughan-Nichols at DesktopLinux.com points out that the favorable result for Linux may cause unpleasant consequences for rival open-source operating system OpenSolaris: 'At one time, Sun was an SCO supporter Sun's Jonathan Schwartz — then Sun VP of software and today Sun's president and CEO — said in 2003 that Sun had bought "rights equivalent to ownership" to Unix. SCO agreed. In 2005, SCO CEO Darl McBride said that SCO had no problem with Sun open-sourcing Unix code in what would become OpenSolaris. "We have seen what Sun plans to do with OpenSolaris and we have no problem with it," McBride said. "What they're doing protects our Unix intellectual property rights." Sun now has a little problem, which might become a giant one: SCO never had any Unix IP to sell. vboulytchev writes "The folks at MySQL has quietly announced that it will no longer be distributing the MySQL Enterprise Server source as a tarball. It's been about a year since the split between the paid and free versions of the database project. The Enterprise Server code is still under the GNU General Public License (GPL), and as a result MySQL appears to be making it harder for non-customers to access the source code. 'One of the things that many users worry about is whether they're getting an inferior version of MySQL by using the Community version. Urlocker says that MySQL "wants to make sure the Community version is rock solid," but admitted that the company has introduced features into the Community edition of the software that "[weren't] as robust as we thought, and created some instabilities." Because of that, the company is revising its policies about when features go into the Community releases.'"
